FAR 52.212-2 Evaluation-Commercial Products and Commercial Services: In accordance with RFO FAR 12.201-1 and FAR 12.201-2 when appropriate, the contracting officer may (1) Insert the provision at 52.212-2, Evaluation-Commercial Products and Commercial Services, in solicitations for commercial products or commercial services. Award MAY be based upon a comparative evaluation of quotes in accordance with the Simplified Acquisition Procedures of RFO FAR 12. Award will be made to the quoter whose quotation represents the best value to the Government, considering price and the non-price factors identified in this solicitation. Comparative evaluation is the side by side pairwise comparison of quotes based on factors resulting in a Contracting Officer decision for the quote most favorable to the Government. Evaluation factors other than price when combined are approximately equal to price. The following are the decision factors: Technical Capability - The Government will assess the Contractor’s ability to demonstrate a clear understanding of the services required and its ability to perform the work adequately and satisfactorily in accordance with the Statement of Work and the extent to which potential risks are identified and mitigated, its qualified key personnel, quality control program, and past experience. Certifications, if applicable, will be evaluated on an acceptable/unacceptable basis to ensure compliance with applicable industry standards. Having no past experience with work of similar nature will be considered a high-risk factor in evaluation. The offeror must demonstrate that it is a contractor regularly engaged in the field of Petroleum Bulk Storage Tank services. Being dependent upon an ostensible subcontractor will be considered as a high-risk factor in evaluation. Past Performance The Government will assess the relative risks associated with a contractor’s likelihood of success in fulfilling the solicitation’s requirements as indicated by the past performance records. The Government may also consider other relevant information when evaluating an offeror’s past/present performance obtained from other federal agency web sites, i.e., the Contractor Performance Assessment Reporting System (CPARS), etc. The Government reserves the right to consider past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement provided by the offeror, as well as information obtained from any other sources, to establish a past performance rating. A proposal containing no relevant past performance shall have past performance evaluated as neutral . Price - The Government will evaluate offers for award purposes based on the pricing for all options to the total price for the basic requirement. The proposed price will be analyzed for reasonableness. It may also be analyzed to determine whether it is realistic for the work to be performed, reflects a clear understanding of the requirements and is consistent with the offeror’s technical proposal. Offers for partial requirement will not be evaluated and will be deemed non-responsive upon receipt. Offerors shall ensure that all pricing is calculated accurately. Any errors on pricing calculations may result in rejection of the offer or require correction at no additional cost to the Government. Options will be evaluated at time of award. For purposes of award, the Government intends to evaluate the option to extend services under FAR 52.217-8 as follows: The evaluation will consider the possibility that the option can be exercised at any time and can be exercised in increments of one to six months, but not for more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be those rates in effect under the contract each time an option is exercised under this clause. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all proposals relative to each other, and will not affect the ranking of proposals based on price, unless, after reviewing the proposals, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8. Offerors must complete annual representations and certifications electronically via the System for Award Management (SAM) website located at https://sam.gov/. FAR 52.212-4, Contract Terms and Conditions Commercial Products and Commercial Services (NOV 2023) (DEVIATION OCT 2025). ADDENDUM to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES. Clauses that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. CL120 Supplemental Insurance Requirements. In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract: Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers. General Liability: $500,000.00 per occurrences. Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage. The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage. 52.217-8 Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days. 52.217-9 Option to Extend the Term of the Contract (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years. 52.222-42 Statement of Equivalent Rates for Federal Hires (MAY 2014).
